Lal Bahadur vs State of Uttar Pradesh & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court partly allowed an appeal against a High Court judgment upholding a change in Lucknow's Master Plan 2021 converting green belt to residential use and subsequent land acquisition. The Court held the conversion unlawful, violating Articles 21, 48A, and 51A(g) of the Constitution and the doctrine of public trust. Since the area had been subsequently developed as a park (Janeshwar Mishra Park) under the Court's interim order and was being maintained as green belt, intervention was declined. The land acquisition stood valid with land vesting in the State. The Master Plan conversion was quashed, requiring the area be held in perpetual trusteeship as a park.
