A Railway Protection Force officer was dismissed following a disciplinary enquiry for alleged negligence in preventing the removal of articles from a godown. Although a lower court initially upheld a reduction-in-pay penalty, the High Court found dismissal disproportionate and set it aside. The Supreme Court upheld the High Court's finding, held even the reduced penalty unjustified, and directed full retiral benefits on a notional basis with continuity of service, plus 33 percent back wages. Though superannuation prevented reinstatement, the officer received all benefits as if continuously employed."
