In Brief

A construction company challenged a High Court decision that set aside an arbitral award on the ground that the arbitrator continued proceedings after retiring from his government post. The Supreme Court held that an arbitration clause specifying an arbitrator's rank (rather than individual identity) does not require the arbitrator's mandate to end upon retirement. The arbitrator's authority to complete proceedings persists unless the clause expressly provides otherwise. Further, once a court has overruled objections to the arbitrator's continuing authority and extended the time to complete the award, those objections cannot be re-raised in appeal. The Court allowed the appeal and restored the award.
