The Supreme Court set aside orders by the trial Court and High Court that had refused to permit defendants to file additional documents under Order VIII Rule 1 of the Code of Civil Procedure, 1908. The Court held that procedural rules serve justice and should not be applied rigidly to deny parties their substantive rights. While delay in filing documents may warrant a costs order, outright denial causes injustice. The defendants were permitted to file and prove the documents, with plaintiffs allowed to adduce additional evidence first before defendants reply."
