Lokesh Katara & Anr vs Hon'ble High Court of Gujarat

Bench: 3 — D.Y. Chandrachud

In Brief

Contractual Systems Officers and Systems Assistants employed by the High Court and district courts in Gujarat challenged a recruitment advertisement for regular posts, seeking their absorption into these positions. The Court declined to entertain the petition, holding that Article 32 is not the appropriate forum as an adequate alternative remedy exists: the petitioners could approach the High Court under Article 226. The Court dismissed the petition but left open the option for them to pursue appropriate proceedings as advised.">
