In Brief
Lovely Salhotra and another challenged the rejection of their petition to quash an FIR registered under sections 420, 494, 506 and 34 IPC. The Supreme Court found no cognizable offence had been made out against the appellants. The FIR appeared to be filed as retaliation to prevent the appellants from prosecuting their own complaint under the Negotiable Instruments Act. The Court held the High Court erred in refusing to quash the FIR merely because investigation against co-accused remained pending. The Court set aside the High Court's order and quashed the FIR against the appellants, allowing the appeal.
