M.C. Mehta vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court upheld a Central Pollution Control Board direction banning the use of furnace oil and pet coke as fuel in Uttar Pradesh, Haryana, and Rajasthan under Section 5 of the Environment (Protection) Act, 1986. Recognizing that this pollution problem extends nationwide, the Court requested all State Governments and Union Territories to adopt similar measures but did not mandate them. The Court also directed the Union, CPCB, and the Amicus Curiae to jointly identify and account for funds collected under previous court orders for pollution control, ensuring their proper utilization. Additional applications were taken on record for further hearing."
