M.C. Mehta vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

In these interim applications concerning BS-IV vehicle emission standards, the Supreme Court held that public health and environmental protection take absolute precedence over the commercial interests of vehicle manufacturers. Rejecting pleas to permit sale of existing BS-III compliant vehicle stock after 1 April 2017, the Court found manufacturers had ample advance notice since 2010 and sufficient resources to transition production. The Court directed a complete ban on sale and registration of non-BS-IV compliant vehicles from that date, except those already sold before the deadline, to protect millions from air pollution hazards.
