This PIL addressed serious pollution concerns in the National Capital Region, including air and water quality issues and waste management deficiencies. The Court found that waste management capacity was inadequate (45% deficit) and that impure water was being supplied to citizens. Invoking Articles 41, 48A and 51A(g), the Court held that the State has constitutional duties to provide potable water, protect air quality, and ensure healthy living conditions. The Court directed State Governments to submit comprehensive reports on air and water quality and water management systems. Construction activity restrictions were conditionally relaxed, pending CPCB review.
