M. R. KRISHNA MURTHI vs THE NEW INDIA ASSURANCE CO. LTD

Bench: 2 — A.K. Sikri, S. Abdul Nazeer

In Brief

A practicing advocate, injured in a 1988 accident at age 18, lost full use of his left leg despite surgeries. The MACT awarded Rs. 8,48,000 in compensation, the High Court affirmed this with minor additions. On appeal, the Supreme Court enhanced compensation for future loss of earnings to Rs. 10,80,000, recognizing the victim's family background of senior lawyers, his education at a prestigious school, and his prospective career in law. Beyond quantum, the Court issued comprehensive directions for motor accident system reform: establishing Motor Accidents Mediation Cells, implementing fast-track disposal procedures within 90-120 days, and adopting an annuity scheme (MACAD) for secure phased disbursement to ensure road accident victims receive adequate, timely compensation.
