M/s. Chitralekha Builders, through its partners, sought to challenge consent decrees passed in an original suit concerning a property development agreement. The appellants were impleaded as defendants only after the first consent decree was passed on 16.02.2005. The High Court dismissed their appeal challenging the consent decrees, holding that they were not bound by orders passed before they became parties. The Supreme Court affirmed this, holding that consent decrees bind only the parties to them. The appellants' substantive rights remain open for examination in their separate suit filed on the property matter, to be decided independently on merits.
