A property buyer sought specific performance of an agreement to sell after the seller tried to back out, claiming the deal was conditional on bank approval of a debt settlement that never materialized. Lower courts rejected the buyer's request for interim protection. The buyer appealed to the Supreme Court, which dismissed the appeal in February 2025. Subsequently, the bank and seller reached a settlement through insolvency proceedings and withdrew the insolvency process in April 2025. The buyer then sought to reopen the Supreme Court's dismissal order. The Court declined, holding that once a matter is finally decided, it cannot be reopened simply because later unrelated events occurred. The Court emphasized that commercial decisions made by creditors in insolvency proceedings fall outside the scope of civil court review.
