M/S RAJCO STEEL ENTERPRISES vs KAVITA SARAFF AND ANOTHER

Bench: 2 — Aniruddha Bose, Sanjay Kumar

In Brief

A steel trading partnership filed cheque dishonour complaints after four cheques totalling 7.75 crores allegedly issued by the accused were returned unpaid, claiming they were issued to settle a financial debt. The accused contended the funds were provided for her to conduct stock market speculation on the complainant's behalf. The trial court convicted the accused, but both the First Appellate Court and High Court acquitted her, finding no documentary proof of any legally enforceable debt and accepting the accused's alternative explanation. The Supreme Court upheld the acquittal, holding that concurrent findings of fact by two appellate courts dismissing the debt claim are neither perverse nor unsupported by evidence, warranting no interference.
