M/S S.D. SHINDE TR. PARTNER vs GOVT. OF MAHARASHTRA & ORS

Bench: 2 — S. Ravindra Bhat, Dipankar Datta

In Brief

A contractor was hired to construct canal infrastructure with an 18-month deadline. Work faced numerous delays caused by the department, leading to extended timelines. After disputes arose over payment for delays and additional costs, the arbitrator awarded the contractor ₹1.50 crores plus interest. The Government challenged the award in court, claiming it was time-barred and showed arbitrator misconduct. The trial court and High Court set aside the award. The Supreme Court reversed both courts, holding the claim was within the limitation period, the arbitrator's findings were evidence-based and legally sound, and the courts impermissibly conducted intense appellate review of factual findings. The award was restored with 12% interest.
