M/s Sitaram Enterprises (landlord) filed contempt petitions against Prithviraj Vardichand Jain (tenant) for willfully violating a Supreme Court order to vacate shop and room premises by 6 March 2024. The tenant had lost eviction suits at trial and appellate stages, and the Supreme Court had dismissed his special leave petitions, granting nine months to vacate. Despite this order, the tenant failed to vacate, did not appear in court despite bailable and non-bailable warrants, and misled police about his whereabouts. The Court held him guilty of contempt, finding his non-compliance deliberate and willful. Rather than imprison him due to his advanced age and health condition, the Court ordered him to vacate within seven days and to reimburse state costs of execution.
