The appellant challenged a High Court order that made suspension of his sentence in a cheque dishonour case (Section 138 of the Negotiable Instruments Act) conditional upon depositing one-fourth of the cheque amount. The Magistrate had imposed a fine of Rs. 10,000, which the appellant had already paid. The Supreme Court held that the High Court's additional deposit condition was not warranted because the fine had already been paid and the Magistrate had set appropriate limits on punishment. The Court vacated the deposit condition and allowed the appeal, requesting the High Court to dispose of the pending revision petition within six months.
