Madhavendra L. Bhatnagar vs Bhavna Lall

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Madhavendra Bhatnagar sought to restrain his wife from pursuing divorce proceedings in the Arizona Superior Court while matrimonial litigation was pending in an Indian court in Madhya Pradesh. The trial court and High Court rejected his request for an interim anti-suit injunction, holding that Indian courts lack power to enjoin foreign proceedings outside their jurisdiction. The Supreme Court reversed both decisions, holding that Indian courts can issue interim anti-suit injunctions against a party to restrain them from pursuing foreign proceedings when matrimonial disputes are pending in India. The Court allowed the appeal and granted the interim relief sought.
