Madhusudan Kabra & Ors vs State of Maharashtra & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court reviewed a land acquisition case where land was acquired in 1992 but the Land Acquisition Collector used 1988 property rates as a benchmark. The High Court had granted a 10% annual increase in compensation, but the appellants sought more. The Supreme Court modified the High Court's order, fixing a 15% annual increase on a compounding basis instead. This provided additional compensation of the disputed amount. However, the Court noted that the appellants' claims for separate compensation for fruit-bearing trees on the land were not addressed in the relief granted. The appeal was partly allowed with the respondents directed to pay the enhanced amount within three months.
