Maharao Bhim Singh of Kota Thr. Maharao Brij Raj Singh, Kota vs Commissioner of Income-tax, Rajasthan-II, Jaipur

Bench: 2 — Abhay Manohar Sapre

In Brief

A former Maharao of Kota sought exemption from income tax on his ancestral palace when part of it was let to the Defence Ministry during requisition. The High Court held the exemption applied only to the portion in his actual occupation. The Supreme Court reversed this, holding that the exemption under Section 10(19A) of the Income Tax Act, 1961 applies to the entire palace as a unit, not portions. The Court distinguished the language of 'palace' from 'house or part of house' in other sections and declined to split the exemption. It also held that the Revenue should not repeatedly pursue resolved issues without compelling justification.", <parameter name="cited_cases">[{"raw_citation": "(1986) 160 ITR 103 (Raj.)", "case_name": "Maharawal Laxman Singh v.
