When 38 villages in Pune were transferred from Zilla Parishad to Pune Municipal Corporation in 1999, primary teachers working there were offered absorption into PMC. The core issue was whether their prior service in ZP should count towards seniority alongside teachers directly hired by PMC. The Supreme Court held that a 1990 Government Resolution and statutory provisions in Appendix IV of the MMC Act expressly required prior ZP service to be deemed service in PMC for all purposes including seniority. The appeal by PMC and directly-hired teachers was dismissed, protecting the merged teachers' accrued seniority rights.
