Maharashtra State Electricity Distribution Co. Ltd appealed against orders by the Electricity Regulatory Commission and APTEL setting aside pre-establishment circulars and policy decisions regarding Captive Power Plants and ordering electricity refunds. The Court held that such circulars and policy decisions validly issued before the Commission's establishment cannot be illegally set aside. Finding that ordering refunds for electricity supplied to manufacture products would constitute unjust enrichment, and that remitting a two-decade-old policy dispute for fresh decision on merits was inappropriate, the Court allowed the appeal and set aside the refund order.
