In Brief
The Supreme Court upheld the autonomy of Maharishi Markandeshwar University, established under a 2010 state statute as an independent institution. The Court held that the University could grant affiliation to its own constituent medical college without being compelled to seek affiliation from Himachal Pradesh University. The Court struck down Section 3(6a) of the 2006 Act (regulating private medical admissions and fees) as unconstitutional because it impermissibly intruded upon the University's autonomy. The Court reasoned that while the 2006 Act governs admissions and fees across private medical institutions, it cannot override special legislation establishing independent universities regarding affiliation matters—which are core to university autonomy.
