The deceased had taken a life insurance policy from Exide Life Insurance but omitted to disclose two other policies with Life Insurance Corporation of India in his proposal form, though he disclosed one policy with Aviva Life Insurance worth Rs. 40 lakhs. The insurer repudiated the claim after he died in an accident. The Supreme Court allowed the appellant's appeal, holding that the failure to disclose the additional policies was not material suppression because he had substantially disclosed another major policy, the undisclosed policies had minor sums, the insurer knew of the Aviva policy, and the death was accidental. The court directed the insurer to pay the full claim with 9% interest, finding the repudiation improper.
