Mahendra Pratap Dubey vs Managing Officer, Evacuee Property & Ors

Bench: 2 — A.M. Khanwilkar

In Brief

A man claimed he inherited evacuee property through a sale certificate allegedly issued to his predecessor by the Custodian of Evacuee Property. He challenged the Managing Officer's decision recognizing another woman's (respondent No.3's) ownership based on a sale certificate issued by the Managing Officer. The Supreme Court held that because the appellant failed to produce any original document proving his predecessors ever received a certificate from the Custodian, and no official register entry existed, his claim was unsubstantiated. Without establishing his own rights to the property, he could not question the Managing Officer's authority or validity of the respondent's sale certificate. The appeal was dismissed.
