Mahesh vs State of Rajasthan & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Mahesh and Arjun were juveniles when they allegedly committed crimes in 2001, including offences under IPC Sections 323, 324, 325, 427, and 455. They were tried in regular criminal court, convicted, and sentenced to three years imprisonment. By the time of this appeal, nearly 17 years later, both had become middle-aged men. The Supreme Court upheld their conviction as the evidence supported guilt. However, it modified the sentence to the period already served (approximately one year and eight months respectively) rather than remanding to the Juvenile Justice Board, finding that remand homes cannot accommodate adults, making such remand impractical."
