The appellant sought a declaration of ownership and permanent injunction over land allegedly encroached by the respondents. The respondents claimed to have acquired ownership through adverse possession. The High Court upheld the adverse possession claim for a 1 Gunta plot. The Supreme Court reversed this decision, holding that adverse possession requires exclusive, hostile, open possession asserting ownership to the true owner's knowledge for 12 years. Since both parties were unaware of exact land measurements and the appellant sued within 12 years of discovering the encroachment in 1983, the respondents could not perfect title through adverse possession.
