The Supreme Court held that under Section 96 CPC, a first appeal is a valuable right requiring the appellate court to reexamine all issues of law and fact, state points for determination, decisions, and reasons (Order XLI Rule 31). The High Court's failure to do so rendered its judgment infirm. The Court allowed the appeal and remanded the matter to the High Court for fresh disposal according to law.
