Managing Committee, Bheramari A.M. High Madrasah & Anr vs State of West Bengal & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court dismissed two special leave petitions challenging the single judge's order regarding administration of a recognised non-government madrasah in West Bengal. The dispute centred on appointment of an Administrator when the Managing Committee failed to initiate the reconstitution process within the prescribed period under the Management of recognised Non-Government Madrasahs Rules, 2002. The Court upheld the single judge's decision allowing the Board to appoint an Administrator and directing facilitation of fresh elections for a new Managing Committee, finding the procedural defaults justified this intervention."
