Supreme Court of India 2017-07-18 remanded

Manjeet Kaur Monga (dead) thr. her Legal Heirs Karan Vir Singh Monga vs K.L. Suneja & Ors

Bench: 2 — Kurian

In Brief

A real estate dispute involved the cancellation of a flat allotment by a builder and recovery of deposits made by the complainant. The Competition Appellate Tribunal awarded compound interest at 15% till the cancellation date (30.04.2005). The appellant sought interest till actual payment; the builder and bank contended against liability. The Supreme Court held that compensation under Section 12B of the Monopolies and Restrictive Trade Practices Act, 1969 encompasses the ordered interest. The Court remitted to the Tribunal the question of compensation for the post-cancellation period and the bank's potential liability for interest, as these issues were not previously considered and the bank was not a party.
