Mannu Prasad Singh vs Union of India and Ors

Bench: 2 — Kurian

In Brief

This appeal concerns the appointment of an Extra Department Branch Post Master in 2001. The Central Administrative Tribunal had directed reconsideration of the selection. The Supreme Court upheld this direction and clarified that during reconsideration, both the appellant and the fourth respondent must be given a hearing. If Respondent No. 4 fails to appear, the appellant's appointment shall be treated as valid and he shall continue in service. The reconsideration must be conducted afresh, free from the tribunal's earlier observations, and shall consider all contentions raised by the appellant.
