In Brief

A 14-year-old girl was enticed away by the accused. She became pregnant after consensual or forced sexual contact with the appellant over several months but disclosed this only when her family discovered her pregnancy. The trial court convicted the appellant under Section 376D IPC (gang rape) among other charges. The Supreme Court partly allowed the appeal, modifying the conviction to Section 376 IPC (rape) as gang rape was not established, and set aside the conviction under Section 506 IPC for lack of clear evidence. It sentenced the appellant for period already undergone (over 8 years), as this sufficed as a deterrent."
