Manphool Singh & Ors vs State of Haryana

Bench: 2 — R. Banumathi

In Brief

In this 2018 criminal appeal, the Supreme Court reduced the conviction of appellants from murder (Section 302 IPC) to causing death by rash act (Section 304 Part II IPC). The accused had been convicted for attacking two men, but the Court found that the accused themselves sustained ten injuries in the incident. As the prosecution failed to explain these injuries, the Court found credible the accused's claim of having acted in self-defence, though the defence exceeded lawful limits. The surviving appellant, who had already served 8-9 years in prison, was released as his sentence was reduced to time served.
