In Brief
This case concerns a property dispute over 51 acres in Panchgani, Maharashtra. After litigation, the parties agreed to divide the land: 10 acres as common area and 20.5 acres each to both parties, as specified in a compromise decree dated July 2017. During execution, the lower court modified this division, claiming the original allotment was "impracticable" due to unauthorized constructions and a prior sale to a third party. The Supreme Court held that an executing court cannot modify a decree on grounds of impracticability. Its jurisdiction is limited to enforcing the decree as written. Unless a decree is a nullity, it must be executed strictly according to its terms. The Court set aside the modifications and directed execution of the original compromise decree.
