Md. Sajjad @ Raju @ Salim vs State of West Bengal

Bench: 1 — Uday Umesh Lalit

In Brief

On 12 July 1993, the body of Ramchandra Singh was found near Calcutta. The prosecution relied mainly on eyewitness identification of the appellant by three witnesses (PW3, PW5, PW16) who had briefly seen him with the deceased on the night of the incident, combined with suspicion arising from business disputes. The trial court convicted the appellant under Section 302 IPC, a decision affirmed by the High Court. The Supreme Court allowed the appeal, holding that identification evidence from a test identification parade held 25 days after arrest, without any prior descriptive details from the witnesses and based on a fleeting nocturnal encounter, could not safely sustain a conviction. Lacking corroboration from other material evidence or a reliable confession, such bare identification, coupled only with suspicion, fell short of proof beyond reasonable doubt. The appellant was acquitted, with the benefit also extended to the non-appealing co-accused.", <parameter name="cited_cases">[ { "raw_citation": "2003 (12) SCC 554", "case_name": "Lal Singh and others v.
