Mewa Ram and Mohan Lal were convicted for murder under Section 302 read with Section 34 IPC. The High Court upheld the conviction. On appeal, the Supreme Court found that while Mewa Ram fired the fatal shot, Mohan Lal's exhortation was directed at killing the complainant Harbans Singh, not the actual deceased Deputy Singh. Since there was no evidence of Mohan Lal's intention to kill Deputy Singh, no common intention under Section 34 could be imputed. The appeal was partly allowed and Mohan Lal's conviction was set aside, while Mewa Ram's conviction was upheld.
