Michelle N. Pinto Souza (Deceased) Through Her Legal Heir & Anr vs Marieta Teresa Petronila De Fatima Mascarenhas E. Pinto & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court allowed the appeal of property suit plaintiffs against an order requiring them to deposit ₹42 lakh in court. The issue arose because the High Court had earlier dismissed the plaintiffs' application for temporary injunction, and the deposit order was a consequence of the Trial Court's initial grant of that injunction. The Court held that once the injunction application itself is dismissed, the dependent order for deposit cannot survive. The defendants conceded the point, and the Court set aside both the Trial Court's deposit order and the High Court's interim order upholding it, allowing the appeal.
