In Brief
In this criminal appeal, the Supreme Court examined the High Court's decision to recall and withdraw its own order dated 18.04.2017 under Section 362 of the Criminal Procedure Code, 1860, on the ground that the order was patently erroneous. The Court held that Section 362 is strictly limited to correcting clerical or arithmetical errors and cannot be used to rehear a matter on merits. The Court set aside the High Court's recall order and the original order, directing the Sessions Court to dispose of the underlying criminal appeal expeditiously through proper legal channels."
