A property dispute spanning 59 years involved a three-storey house in Almora with a complex ownership and mortgage history dating back to 1872. The plaintiff claimed full ownership after redemption of the mortgaged property and sought to evict tenants. Tenants challenged the trial court's finding that the plaintiff owned the full property. The Supreme Court held that tenants cannot challenge ownership findings on appeal—only the actual claimant to title (the mortgagee) had standing to do so. Since the mortgagee did not challenge the trial court's finding, the tenants' appeal was not maintainable. The Court restored the trial judgment decreeing possession in favour of the plaintiff."
