In Brief
Goverdhanlal executed a will in 1945 bequeathing his house property to the respondent (Nandlal), his son. After Goverdhanlal's death in 1947, the respondent sought ejectment of the appellant (his younger brother) from the disputed property. The appellant claimed entitlement as a grandson. The courts below accepted the will's validity and decreed the suit in the respondent's favour. The Supreme Court upheld the decision, finding the will genuine (handwriting proved, previously pledged as bank security), and rejected the appellant's reliance on municipal name mutation as establishing property rights without cogent evidence.
