Mohd. Inam vs Sanjay Kumar Singhal & Ors

Bench: 2 — Sanjay Kumar

In Brief

Mohd. Inam challenged the High Court's order that interfered with the District Judge's decision reversing an eviction order passed by the Rent Controller under the U.P. Urban Buildings Act. The Supreme Court held that the High Court erred in exercising its revisionary jurisdiction under Article 227 to set aside the District Judge's well-reasoned order. The District Judge had correctly found the Rent Controller's eviction order was contrary to law and based on perverse reasoning. The Court found the High Court's intervention unjustified and allowed the appeal, restoring the District Judge's reversal of the eviction.
