Mohd. Ismail vs State of Rajasthan and Anr

Bench: 2 — A.K. Sikri

In Brief

The appellant was accused of cheating a relative by taking Rs. 22 lacs as partial payment for a flat purchase with false assurances. The complainant lodged an FIR under Sections 420 and 406 IPC, and the trial court began recording evidence in the appellant's absence. The appellant petitioned the High Court to quash the proceedings. The Supreme Court found that the entire amount had been paid to the complainant and no dispute remained between the parties. Holding that no useful purpose would be served by continuing the trial, the Court quashed all proceedings arising from the FIR.
