In Brief
A Pakistani national convicted of heroin trafficking in two separate cases sought to have both sentences run concurrently. The first case resulted in 12 years imprisonment for 4 kg heroin recovery in Punjab; the second case resulted in 15 years imprisonment for 750 grams heroin recovery in Delhi. The Supreme Court dismissed the appeal, holding that under Section 427 of the Criminal Procedure Code, sentences for different transactions with different crime numbers decided by different courts ordinarily run consecutively unless the court specifically directs otherwise. Since no such direction was issued, and considering the serious nature of NDPS offences, concurrent sentences were not warranted.
