In this civil appeal concerning a disputed commercial tenancy, the Supreme Court held that after the tenant surrendered vacant possession of the premises, disputes over mesne profits and use and occupation charges should be referred to an appropriate forum rather than adjudicated by the Court. The Court directed the petitioner-company to deposit Rs. 1,00,000 per month as provisional compensation for use and occupation from May 2010 onwards, clarifying this deposit was subject to modification. The parties were given liberty to file documents establishing the property's market rental value and were left free to pursue their grievances in a competent forum. The contempt petition was dismissed.
