Municipal Council Bawal sought restoration of an appeal that had been dismissed with delay. The Supreme Court allowed condonation of the delay and recalled the dismissal order. However, on the merits of the appeal regarding an encroachment dispute over land, the Court found concurrent findings by both the first appellate court and High Court that the Municipal Council had encroached upon the plaintiffs' property without acquiring title. The demarcation done by the appointed Local Commissioner was carried out lawfully in the presence of the Council's representative and was unchallenged through cross-examination. The appeal was ultimately dismissed on the merits.
