A municipal council appointed a social studies teacher on a permanent basis with a condition that she would relinquish the post if the original incumbent won her legal case. When the original incumbent was reinstated after nine years, the council terminated the respondent's services with inadequate notice and opportunity to be heard. The Supreme Court held the termination violated natural justice principles but modified the relief to reflect the conditional nature of the appointment. The respondent was awarded reinstatement from the date the original incumbent superannuated, fifty percent back wages for the intervening period, and full salary from reinstatement onwards, but not full arrears for the entire ten-year gap."
