N. Ramamurthy, convicted of forgery, misappropriation, and corruption offences as a bank clerk, was sentenced by the trial court to concurrent sentences totalling a maximum of 7 years imprisonment. The High Court rejected his petition for suspension of execution of sentence, erroneously stating he had been sentenced to 45 years. The Supreme Court set aside the High Court's orders, holding they were vitiated by two fundamental misconceptions: (1) confusion between concurrent and consecutive sentences, and (2) misapplication of principles governing suspension of conviction to suspension of sentence. The Court clarified that suspension of sentence in Prevention of Corruption Act cases should ordinarily be granted unless the appeal can be heard soon after filing, and remitted the matter to the High Court for fresh consideration.
