A driver employed by Karnataka State Road Transport Corporation hit a railway crossing gate with his bus in 2006, causing damage. He was convicted under Section 160(2) of the Railways Act and sentenced to six months imprisonment. The High Court upheld the conviction. The Supreme Court held that concurrent findings of three courts are binding, so the conviction stands. However, the Court reduced the sentence to time already served (one month), finding the six-month term excessive and disproportionate given that no human injury occurred, the offence involved no moral turpitude, and thirteen years had elapsed. The appeal was partly allowed.
