The Supreme Court dismissed an appeal challenging a lower court's judgment upholding a suit for partition and setting aside sale deeds executed by a natural guardian. The key issue was whether a suit filed in 1989 against a 1982 sale deed was barred by limitation. The Court held that Article 60 of the Limitation Act (three-year period from attaining majority) applies to suits by minors challenging guardian-made transfers, not Article 109 (twelve years, applicable only to father's alienations). Since one plaintiff was only 20 years old at suit-filing and another was minor, and a valid discharge could not be given without the minor's consent, limitation had not expired. The appeal was dismissed.
