This case concerns the interpretation of succession and eviction rights under the West Bengal Premises Tenancy Act 1997. The appellant challenged an eviction decree affecting a premises. The Supreme Court examined Section 2(g) of the Act, which defines 'tenant' and governs what happens to a tenancy upon a tenant's death. The Court held that the surviving spouse of a deceased tenant is protected from eviction without the standard five-year limitation period. Additionally, the Act grants other family members (children, parents, or the widow of a pre-deceased son) a right to renew the tenancy on payment of fair rent, provided they ordinarily lived with the tenant. Finding no reason to set aside the eviction decree on the facts, the Court dismissed the appeal.
