The Motor Accident Claims Tribunal awarded Rs. 37,71,000/-; the High Court enhanced it to Rs. 48,00,000/-. The insurer challenged the amount and claimed deduction of an ex gratia payment from the employer; the claimants sought higher interest rates. The Supreme Court held the High Court's award was just compensation, rejecting the insurer's deduction argument as the ex gratia payment was not statutory recurring assistance. The 7.5% interest rate was reasonable. Both appeals were dismissed."
